Effective date: October 29, 2026
THIS NOTICE DESCRIBES HOW HEALTH INFORMATION ABOUT YOU MAY BE USED AND DISCLOSED AND HOW YOU CAN GET ACCESS TO THIS INFORMATION. PLEASE REVIEW IT CAREFULLY.
1. My commitment to your privacy
Your health information is personal, and I am committed to protecting it. I keep a record of the care I provide you, both to give you quality care and to meet legal requirements. This notice applies to all records of your care in my practice.
The law requires me to:
- Keep your protected health information (PHI) private.
- Give you this notice of my legal duties and privacy practices.
- Follow the notice currently in effect.
- Notify you promptly if a breach occurs that may have compromised the privacy or security of your information.
Stricter state law. Where the law of a state where I practice protects your information more strictly than federal law, I follow the stricter rule. This includes state protections for mental health records, HIV-related information, and certain substance use treatment records.
Privacy contact. I am the privacy officer for my practice. For questions about this notice or to exercise any right below, contact me at info@jonprezant.com or 201-835-9681.
2. How I may use and disclose your information without your authorization
Treatment, payment and health care operations. Federal law lets me use and disclose your information to treat you, to receive payment, and to run my practice. Examples: consulting with another licensed clinician about your care without revealing your identity; coordinating with a physician or other provider you are seeing; preparing a superbill for you; or using HIPAA-compliant vendors for scheduling, records, billing and video sessions. Each vendor signs a business associate agreement requiring it to protect your information. Disclosures to another provider for treatment are not limited to the minimum necessary, because that provider may need complete information to care for you.
Appointment reminders. I may contact you to remind you of appointments, and tell you about other services I offer that may be relevant to your care.
Other permitted or required disclosures. Subject to limits in the law, I may also disclose your information without your authorization:
- When required by state or federal law, limited to what that law requires.
- To report suspected abuse or neglect of a child, or of an elderly or vulnerable adult, where state law requires it.
- To prevent or lessen a serious and imminent threat to the health or safety of you, another person, or the public.
- For health oversight activities, such as audits or investigations by a licensing board.
- In judicial and administrative proceedings, in response to a court or administrative order, or to a subpoena or similar request when legal requirements are met, including efforts to notify you or obtain a protective order. Whenever possible, I will seek your authorization first.
- For law enforcement purposes when required by law, limited to what is required.
- To coroners or medical examiners performing duties authorized by law.
- For specialized government functions, such as national security or the safety of people in correctional institutions.
- To comply with workers’ compensation laws. Whenever possible, I will seek your authorization first.
- To the Secretary of Health and Human Services, to investigate my compliance with federal privacy law.
3. Uses that require your written authorization
Psychotherapy notes. I keep psychotherapy notes, as defined in 45 CFR ยง 164.501, separately from your clinical record. Using or disclosing them requires your written authorization, except:
- For my own use in treating you.
- For training or supervising mental health practitioners under my direction.
- To defend myself in a legal proceeding you bring.
- When the Secretary of Health and Human Services investigates my compliance with federal privacy law.
- When required by law, limited to what that law requires.
- For health oversight of the practitioner who wrote the notes.
- To a coroner or medical examiner performing duties authorized by law.
- To prevent or lessen a serious and imminent threat to the health or safety of others.
Marketing and sale. I will never use your information for marketing or sell it.
All other uses. Any use or disclosure not described in this notice requires your written authorization. You may revoke an authorization in writing at any time. Revoking it does not undo disclosures I already made in reliance on it.
Couples therapy. In couples therapy, the record belongs to the joint treatment. I will not release it without written authorization from both partners, unless the law requires it.
4. Disclosures you can object to
I may share relevant information with a family member, friend or other person you identify as involved in your care or in paying for it, unless you object. In an emergency, or if you cannot agree or object, I may share what I judge to be in your best interest and will tell you afterward.
5. Your rights
To exercise any of these rights, contact me in writing at info@jonprezant.com.
- See and get a copy of your record. You may get an electronic or paper copy of your record, other than psychotherapy notes. I will respond within 30 days of your written request. I may charge a reasonable, cost-based fee, or provide a summary if you agree. If I deny any part of your request, I will explain why in writing and tell you how to have the denial reviewed.
- Ask me to correct your record. If you believe information is wrong or missing, you may ask me to correct or add to it. I may say no, but I will tell you why in writing within 60 days.
- Ask for confidential communication. You may ask me to contact you in a particular way, such as only by email or at a different address. I will agree to all reasonable requests.
- Ask me to limit uses and disclosures. You may ask me not to use or disclose certain information for treatment, payment or operations. I am not required to agree, and may decline if it would affect your care.
- Limit what goes to your health plan. If you pay for a service in full out of pocket, you may ask me not to share information about it with your health plan, and I will agree unless the law requires the disclosure.
- Get a list of disclosures. You may ask for a list of disclosures I made in the past six years for purposes other than treatment, payment, operations, or those you authorized. I will respond within 60 days. The first list each year is free; I may charge a reasonable cost-based fee for additional requests in the same year.
- Choose someone to act for you. If you have given someone medical power of attorney, or someone is your legal guardian, that person can exercise your rights. I will confirm their authority first.
- Get a copy of this notice. You may get a paper or electronic copy at any time, even if you agreed to receive it electronically. It is also posted at jonprezant.com.
6. Complaints
If you believe your privacy rights have been violated, you may file a complaint with me at info@jonprezant.com or 201-835-9681. You may also file a complaint with the U.S. Department of Health and Human Services, Office for Civil Rights, at www.hhs.gov/ocr/complaints or 1-800-368-1019.
I will not retaliate against you in any way for filing a complaint.
7. Changes to this notice
I may change the terms of this notice, and the changes will apply to all information I hold about you. The current notice will be posted at jonprezant.com, available in the client portal, and sent to you on request.
